A 92 -year -old care house resident in a wheelchair was sprayed on the face with synthetic pepper spray before the meat was priced and hit with a cane by police officers, a jury said.
PC Stephen Smith emptied almost a complete can of pepper spray on the face of Donald Burges when he refused to drop an article or cutlery similar to a butter knife, according to the court of the Southwark crown.
Mr. Burgess was priced by PC Rachel astto, the images of the police chambers shown to the jurors seemed to be shown.
PC Smith, 51, denies two assault positions through the use of spray turkey and a cane, and PC as a assault charge by rare off its taser.
Burgess was a resident in a house in St Leonards-on-Sea, East Sussex, when the staff called the police on June 21, 2022 after they could not persuade him to deliver the knife, which had a special specialized handle.
Paul Jarvis KC, rijing, told the jury that the officers did not try to talk to the staff, and instead approached Mr. Burgess, trying to interact with him.
He said that instead of trying to calm the situation, they inflamed it, using unjustified and illegal force.
They were told to the jurors that there was no one within the reach of Mr. Burgess at that time, and that it should have become clear that it was not mobile.
“I should have the obvious leg because it had a leg that this was a man who is not going to be mobile,” said Jarvis.
“This was an old and vulnerable man who may not have understood what was happening.
“Instead of being with understanding and sympathy, he faced irritation and discomfort by the defendants.”

Jarvis KC, he told the Court, Mr. Burgess suffered a urinary tract infection on the day of the incident, a condition that can confuse a person, agitated or even aggressive.
He told Mr. Burgess he was asked to deliver the knife after he used to have thrown the food and click on a staff member in the stomach.
Jarvis said the managers had 30 minutes trying to lower the knife.
Burgess, which suffered from multiple health conditions, including diabetes and carotid artery disease, had a resident at home since 2018.
He had not diagnosed dementia, but the home of specialized care in support for people with the condition.
‘Unnecessary and excessive’
It was told to the court that a minute and 23 seconds passed among the officers who arrived and that Mr. Burgess was priced.
In the camera worn by the body, you can listen to the video PC Smith repeatedly by asking Mr. Burges, who was an amputated right leg, to leave the knife.
When it does not move, PC Smith sprayed it with turkey, before using its cane and 12 seconds later, you can see Burges crying with pain when PC astto uses its taser gun.
PC Smith then take Mr. Burge’s knife.
Burgess was hospital tasks after the incident and then contracted Covid. He died 22 days later.
Jarvis told the jury: “I want to make it clear: these defendants are not responsible for his death.
“He was an old gentleman who was not right.”
But he added: “The force used was unnecessary and excessive in the circumstances.
“The defendant assaulted Mr. Burgess, causing real bodily damage.”
The trial was postponed until Tuesday.
