A judge ordered that Scottish schools must provide single -sex toilets for students after parents presented a case to court against the Council of Scottish edges (SBC).
The local authority had installed only gender neutral baths at Earlston replacement primary school, which was opened recently.
The parents are Stratford and Leigh Hurley complained to the Council on politics at school to their son who had previously attended, but was rejected.
But in the session court in Edinburgh, the Council admitted that they had the legal obligation to provide male and female facilities.
The measure occurs after the judges of the Supreme Court of the United Kingdom last week unanimously ruled that a woman is defined by biological sex under the equal law.
Rosie Walker, or the law firm Gilson Gray, which represents the parents, said: “This case will have a large range.”
BBC Scotland News understands that the Scottish government is confident that the vast majority of schools in Scotland are already those of single -sex washing machines.
The ministers are still considering the involvement of the Supreme Court Judgment and if changes in the bathroom provisions will have to be made.
Mrs. Walker said that all schools in Scotland would now have to “urgently review” if half of their bathrooms are for boys and half for girls, as required by school facilities (general requirements and standards) (Scotland) Regulations 1967.
He added: “This case, in addition to the decision of the Supreme Court last week, focuses on the importance of protecting sexual rights and single -sex spaces.”
A Board spokesman said: “Before the hearing, SBC had accepted and recognized that the decision that was sought was correct and, therefore, did not see to defend this in court.
“In the future, SBC will visit and reconsider the complaint and respond in due time.”
The Scottish government said it would consider the implications of that decision.
A spokesman added: “Local authorities have legal responsibility for school heritage, including the provision of bathrooms.
“The Scottish government undertakes to ensure that our transgender orientation for schools updated and fits their purpose.
“As with any significantly legal or policy development, we will consider whether to update to reflect on the thesis.”
They added to the Secretary of Social Justice and the Secretary of Health will meet with the Commission on Equality and Human Rights, which will soon publish guidance on the subject, Thursday.
